The Benue State Ministry of Justice and Public Order is the Legal Arm of the Government of Benue State saddled with the responsibility of representing the State in all legal matters. Defending the State in Criminal and Civil cases is the responsibility of the Ministry of Justice.

Ministry of Justice and Public Order

The Ministry of Justice and public order is essentially a professional and service oriented Ministry established to render legal services to the Government of Benue State and all its agencies. It is responsible for the operation of the machinery of government in general and the administration of justice in particular. In achieving the Governor's Strategic Development Plan for the Justice sector, the Benue State Attorney General and Commissioner for Public Order, has framed five strategic objectives as follows;

  1. Enhancement of access to justice through strengthening of justice systems for effective and efficient justice delivery.
  2. Increase security, peace and stability through strengthening of the public order

Justice Sector Institutions

There are Five (5) justice sector institutions or entities in Benue State that draw from the budgetary allocation from the State annual budget. These are;

  1. Ministry of Justice
  2. High Court of Justice
  3. Customary Court of Appeal
  4. Judicial Service Commission
  5. Citizens Mediation Center

His Excellency, Revd. Fr. Dr Hyacinth Alia in his blueprint “A Strategic Development Plan for a Greater Benue” made provisions for Justice Administration as follows:

  1. Furnish the Judiciary and Ministry of Justice and public order with adequate modern equipment’s.
  2. Improve management capacity injustice sector institutions.
  3. Revamp the State Law Reform Commission.
  4. Sponsor the review and re-enactment of the laws of Benue State, Nigeria.
  5. Reform the Benue State Judiciary to create room for Alternative Dispute Resolution (ADR).
  6. Provide funding for the training and continuing education of Staff of the Ministry of Justice
In pursuance to the Governor's Strategic Development Plan, this implementation plan to give effect to the Strategic Development plan in the justice sector.

Vision and Mission

Section 195 of the Constitution of the federal Republic of Nigeria 1999 states that "There shall be an Attorney General for each State who shall be the Chief Law Officer of the State and Commissioner for Justice of the Government of that State. Section 211 of the Constitution The Attorney General of a State shall have power

To institute and undertake criminal proceedings against any person before any court of law in Nigeria other than a court- martial in respect of any offence created by or under any law of the House of Assembly.

To take over and continue any such criminal proceedings that may have been instituted by any other authority or persons, and


To discontinue at any stage before judgment is delivered any such criminal proceedings instituted or undertaken by him or any other authority or person. The powers of the AG may exercised by him in person or through officers of his department.
